Terms and Conditions
10. ALL OF THE TERMS AND PROVISIONS OF THIS AGREEMENT, WHETHER SO EXPRESSED OR NOT, SHALL BE BINDING UPON, INURE TO THE BENEFIT OF, AND BE ENFORCEABLE BY THE PARTIES AND THEIR RESPECTIVE ADMINISTRATORS, EXECUTORS, LEGAL REPRESENTATIVES, HEIRS, SUCCESSORS, AND PERMITTED ASSIGNS. SUPPOSE YOU ELECT TO CHARGE BACK YOUR DEPOSIT FOR ANY REASON DURNING THE TERMS IN SECTION 8 AS FOLLOWS ( 48 HOUR CANCELLATION POLICY) ( NO REFUND FOR ANY MOVES BROKERED AND, OR BOOKED WITHIN A 7 DAY PICK UP DATE OF BOOKING WITH MENARDS MOVING AND STORAGE LLC ), YOU WILL THEN BE HELD RESPONSIBLE FOR THE SUM OF 10,000 DOLLARS USD TO MENARDS MOVING AND STORAGE LLC, FOR DAMAGES TO THIER NAME AND ALSO MOST OF ALL THIER BANK AND OR THERE MERCHANTS. THIS CLAUSE IN THE CONTRACT BEFORE YOU TODAY ALSO STATES BY SIGNING THIS CONTRACT YOU ARE ACTING IN FULL KNOWLEDGE, KNOWING THAT NO ONE, AND I MEAN NO ONE, HAS INFLUENCED OR COERCED YOU IN ANY DECISION MADE HERE TODAY. ALSO, HERE TODAY YOU AGREE YOU ARE NOT UNDER ANY DRUGS OR MIND ALTERING SUBSTANCES TODAY THAT WOULD AFFECT YOU TO SIGN THIS CONTRACT TODAY. LASTLY, YOU AGREE ONCE MORE THAT YOU ARE ACTING IN FULL KNOWLEDGE, KNOWING THAT NO ONE, AND I MEAN NO ONE, HAS INFLUENCED OR COERCED YOU IN ANY DECISION MADE HERE TODAY. BY SIGNING THIS CONTRACT, YOU HAVE AGREED TO THESE TERMS UNDER MENARDS MOVING AND STORAGE TERMS AND CONDITIONS AND ALSO BY STATE AND FEDERAL CONTRACT LAW AND WILL BE HELD 100% RESPONSIBLE FOR THE SUM DUE TO MENARDS MOVING AND STORAGE LLC. IF YOU ELECT NOT TO HONOR THIS SUM OR THIS CONTRACT UNDER SECTION 8 AND SECTION 10, MENARDS MOVING AND STORAGE WILL THEN FILE A STATE OR FEDERAL JUDGMENT FOR THE SUM OF $250,000 USD, WHICH WILL BE ISSUED TO YOU UNDER STATE OR FEDERAL LAW. ADDITIONALLY, IN THE EVENT OF A VIOLATION OF THIS CONTRACT AND ITS TERMS, IN SECTION 8 AND SECTION 10, YOU WILL BE HELD RESPONSIBLE FOR ALL COURT COSTS, ATTORNEY FEES, AND ANY OTHER EXPENSES INCURRED BY MENARDS MOVING AND STORAGE LLC IN FIGHTING THIS CASE IN A STATE OR FEDERAL COURTROOM.
26. * LASTLY WE ARE NOT! MENARDS THE STORE! MEANING MENARDS INC. WE HAVE NOTHING TO DO WITH THEM IN ANY SHAPE, FORM, OR FASHION! WE ARE IN THE TRANSPORTATION BUSINESS, NOT THE SALE OF HOME IMPROVEMENT GOODS, BUILDING MATERIALS, HARDWARE, OR ANY OTHER RELATED RETAIL ACTIVITIES THAT ALIGN WITH MENARDS INC. ONCE AGAIN WE ARE MENARDS MOVING AND STORAGE (NOT) MENARDS INC.
Cancellation Policy
Should you elect to cancel your move with menards moving and storage (your moving broker), you must email support@menardsmoving.com within 48 hours of signing the contract. If you cancel your move within 48 hours of the originally signed contract, you will receive a full refund as long as you are not booking your move within (7) business days of your pickup date. If your move is booked within (7) business days of your scheduled move date all deposits are non-refundable, however, all deposits may be applied to a future move with menards for up to 12 months from the date of the original signed contract. All refunds will be processed within 30 business days of the cancellation if the cancellation was received within the refund window. Any updated contracts signed after the initial contract is signed will abide by the 1st contract signed regarding refunds. The cancellation policy starts from the original date of booking and only cancellations from 48 hours of that date are considered refundable as long as they are not scheduled to move within 7 business days of the original booking. Please understand that by signing this binding estimate you are waiving your right (if outside of the cancellation window) to charge back deposit for any reason (examples including but not limited to fraud, services not rendered, services not as agreed, etc…). Customer also agrees by signing this binding estimate that you are waiving the right to credit card arbitration if a charge back is initiated.
